Abstract

Fiqh has a central role as a legal instrument to regulate the life of Muslim society. They need a legal instrument whose character is no longer purely textual normative, as is the case with the Qur'an and hadith, but which is already structured into an applicable legal institution (fiqh). Unfortunately, fiqh often positions itself as the holy and untouched Al-Quran and Hadith. For Kyai Sahal, fiqh is not a dogmative-normative concept, but an active-progressive concept. His thoughts on social fiqh opened a new discourse in positioning fiqh as an instrument for realizing benefit.
